IT IS RECOMMENDED THAT YOUR BOARD:

PURPOSE OF RECOMMENDED ACTION

This recommended action is for your Board to initiate proceedings for the annexation of territory into County Lighting Maintenance District 1687 and County Lighting District LLA-1, Unincorporated Zone, and authorize the preparation and filing of an Engineer's Report .

JUSTIFICATION

Petition 294-99 (Laxford Road) favoring the installation of street lights was signed by property owners representing 69 percent of the area proposed to be annexed to County Lighting District LLA-1, Unincorporated Zone. This complies with the 60 percent or more requirement in the policy adopted by your Board on March 11, 1980. The enclosed Petition indicates the approximate assessment for the installation, operation, and maintenance of the street lights to be paid by the property owners within the territory to be annexed.

FISCAL IMPACT

The street lights would be installed by Southern California Edison Company at no cost to the County or the property owners. There are sufficient funds available in the Lighting Districts to pay for the operation and maintenance cost of these street lights until assessments can be collected from the property owners within the territory to be annexed.

FINANCING

Financing is not required.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

These proceedings are governed by Chapter 26 of the Improvement Act of 1911 (Section 5820 et seq. of the Streets and Highways Code), the Landscaping and Lighting Act of 1972 (Section 22500 et seq. of the Streets and Highways Code), and Article XIIID of the California Constitution (Proposition 218 approved by California voters in November 1996). Public Works will prepare an Engineer=s Report that complies with Section 22565 et seq. of the Streets and Highways Code and Article XIIID, Section 4(b), of the California Constitution.

After your Board approves the Resolution Initiating Proceedings to Annex Territory to County Lighting District LLA-1, Unincorporated Zone, a separate Resolution of Intention to Annex Territory to County Lighting Maintenance District 1687 and County Lighting District LLA-1, Unincorporated Zone, will be submitted for your Board's consideration and adoption. The Engineer's Report will be filed at a later date.

The Resolution Initiating Proceedings to Annex Territory to County Lighting District LLA-1, Unincorporated Zone, has been approved as to form by County Counsel.

None.

At such time as this recommendation may be approved by your Board, please return one approved copy of this letter and the signed Resolution to Public Works, and we will forward three approved copies to the Auditor-Controller.
