CAPACITY BUILDING AMENDMENTS
(All Districts) (3 Votes)
IT IS RECOMMENDED THAT YOUR BOARD:
Approve and instruct the Acting
Director of Health Services, or his designee, to sign 49 HIV/AIDS service and
improvement amendments, substantially similar to Exhibits I through XLIX with
the contractors listed on Attachment B, for the time and amounts specified. The
total County maximum obligation for these agreements is increased by
$2,170,340, from $14,518,868 to $16,689,208, effective upon Board approval
through June 30, 2002. The $2,170,340 increase is one-time funding and is
offset by $1,225,355 in Federal funds, $800,985 in State funds, and $144,000 in
net County cost.
PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION:
In approving this action, your Board is authorizing the
Acting Director of Health Services, or his designee, to increase funding for
the 49 HIV/AIDS community-based contractors identified in Attachment B, for the
development and implementation of capacity building activities, and to provide
for additional resources which include information and telecommunication
systems and/or upgrades, fund raising techniques, promotion of services, needs
assessment, program development, strategic planning, program evaluation, and
minor facility improvement to enhance the overall provisions of HIV/AIDS
services throughout Los Angeles County.
In
approving this action, your Board is authorizing the extension of all contracts
listed on Attachment B through June 30, 2002 except for the Health
Education/Risk Reduction Prevention Services (HERRP) agreements; three of these
HERRP agreements are in effect through December 31, 2003 and 16 are in effect
through June 30, 2003.
FISCAL
IMPACT/FINANCING:
These
amendments will increase the County maximum obligation for these agreements
from $14,518,868 to $16,689,208, an increase of $2,170,340. This increase is
offset by $1,072,355 in Federal Health Resources and Services Administration
(HRSA) for Ryan White Comprehensive AIDS Resources Emergency (CARE) Act Title I
Year 11 funds, $153,000 in Federal Centers for Disease Control and Prevention
(CDC) funds, $338,600 in California Department of Health Services (CDHS) Office
of AIDS funds, $462,385 in CDHS Title I Year 11 funds, and $144,000 is net
County cost. Attachment B identifies each contract and the revised maximum obligation
for the term specified.
The
total program cost, inclusive of the $2,170,340 increase, is $16,689,208, which
is offset by the following funding: $6,711,697 in HRSA CARE Act Title I Year 11
funds, $1,913,224 in CDC funds, $3,198,321 in CDHS Office of AIDS funds,
$21,300 in CDHS AIDS Drug Assistance Program (ADAP) funds, $1,166,479 in CDHS
Title II Year 11 funds, and $3,678,187 is net County cost.
Payments
will be on a cost reimbursement basis and are subject to performance.
Funding
for these one-time only Capacity Building amendments is included in the Fiscal
Year 2001-02 Final Budget.
FACTS
AND PROVISIONS/LEGAL REQUIREMENTS:
Since
1983, the County has accepted funding from Federal and State funding sources
for the provision of various HIV/AIDS services.
In
response to the April 20, 1999 Board motion, and in collaboration with
community partners, the Department of Health Services (DHS or Department)
expanded its role and assumed a leadership position in assuring a high quality
of care by providing the resources to strengthen and/or develop strong
organizational infrastructures to close the disparity gap in the delivery of
HIV/AIDS services.
Since
June 1999, the Department has been conducting periodic needs assessments to
establish the type of assistance that would be the most efficient and effective
to assist the community-based organizations. In October 1999, because of the
challenges faced by the small community-based contractors, agencies with
HIV/AIDS operating budgets of less than $4 million dollars were given
preference. Governmental, academic, and hospital-based providers of HIV
services were not included in the assessments.
Recommendation
for additional funding was determined based on the individual statement of
need, detail of how the provision of overall HIV services provided by their
agency would be enhanced with a one-time only augmentation, and budget
justification.
The
agreements have various commencement dates that will remain unchanged by the
recommended amendments. The amendments will become effective upon Board
approval and the terms as to all agreements except the Health Education/Risk
Prevention Services agreements will be extended through June 30, 2002. Three of
the Health Education/Risk Services agreements will remain in effect through
December 31, 2003 and 16 will remain in effect through June 30, 2003.
All
of the amendments include the most recent "Indemnification",
"General Insurance Requirements", "Insurance Coverage Requirements",
and "Contractor Responsibility and Debarment" provisions, and the
amendments include an updated ADDITIONAL PROVISIONS section with the
following new provisions: "Purchasing Recycled-Content Bond Paper",
"Rules and Regulations", "Contractor's Willingness to Consider
County's Employees For Employment", and "Covenant Against Contingent
Fees".
Under
the termination provisions, the agreements may be terminated for convenience by
the County upon 10 days advance written notice to contractor, and by the contractor
upon 30 days advance written notice to the County.

Counsel has approved the amendments (Exhibits I through XLIX) as to form.

ON CURRENT SERVICES (OR PROJECT):
Approval
of the amendments will enable the Department to provide additional resources to
assist existing community-based organizations to develop and sustain a strong
infrastructure which will enhance the delivery of HIV/AIDS services.

approved, this Department requires three signed copies of the Board's action.
