JOINT RECOMMENDATION WITH THE CHIEF ADMINISTRATIVE OFFICER AND THE DIRECTOR OF HEALTH SERVICES THAT YOUR BOARD:

PURPOSE OF RECOMMENDED ACTION

The recommended actions will allow the County to advertise for bids for site preparation work for the LAC+USC Medical Center Replacement Project. The site preparation work includes the demolition of several existing buildings on the project site, relocation of existing utilities, excavation of future building foundations, removal of abandoned underground structures, shoring for the new hospital facilities, installation of landscaping and a sound barrier wall along Chicago Street, and improvements to several streets to accommodate the project.

JUSTIFICATION

On September 15, 1998, your Board authorized the Director of Public Works to commence design of a 600-bed LAC+USC Medical Center Replacement Project, and on June 6, 2000, certified the Environmental Impact Report for the proposed project. The project is consists of several construction bid packages including Site Preparation, Outpatient Building, Central Plant, Diagnostic and Treatment Facility, and Inpatient Tower. The first of these construction bid packages is the Site Preparation, which consists of demolition, grading, and other work necessary for future construction of the new replacement hospital.

As part of the site preparation work, a portion of Cummings Street between Marengo and Charlotte Streets, which currently meets City Collector Street standards, is going to be closed and demolished. The Los Angeles City Department of Transportation has requested that the County improve Charlotte and Chicago Streets to City Collector Street Standards between Zonal Avenue and Marengo Street prior to the closure of Cummings Street. These street improvements have been included as part of the site preparation work.

The Department of Transportation also specified that a street vacation request be approved by the Los Angeles City Bureau of Engineering and the City Council. In a report dated June 21, 2000, the City Engineer recommended approval of the vacation request. On August 8, 2000, the City Public Works Board considered the matter, at which time Councilmember Pacheco=s office submitted a letter requesting that the following conditions be placed on the vacation approval:

The cost of implementing all of these conditions is estimated at $119 million resulting from direct costs to implement the conditions as well as escalation of basic construction costs resulting from delays in beginning construction. To date, staff efforts to resolve these issues with the Council member=s office have been unsuccessful. We will continue to try to negotiate these issues with the City. Proceeding with the advertisement of bids at this time, however, will minimize any delay in the project schedule, thus minimizing the financial impact of the construction delays, while these issues are negotiated.

FISCAL IMPACT

On July 7, 1998, your Board approved a total project budget of $818,000,000. The estimated construction contract cost range for the recommended work is $10,200,000 to $14,000,000. Sufficient funds are available in the total project budget for this work. The project schedule and budget summary are included in Enclosure A.

FINANCING

Financing for the project is currently being provided through the issuance of Bond Anticipation Notes and State and Federal disaster assistance monies. Future construction and medical equipment costs will be financed by the County through the issuance of medium- and long-term bonds and State and Federal earthquake disaster assistance funds.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

Construction documents have been approved by all County jurisdictional agencies and by the California Office of Statewide Health Planning and Development.

The project specifications contain provisions requiring the contractor to report solicitations of improper consideration by County employees and allowing the County to terminate the contract if it is found that the contractor offered or gave improper consideration to County employees.

As requested by your Board on August 12, 1997, and as a threshold requirement for consideration for contract award, bidders will be required to demonstrate a proven record of hiring Greater Avenues for Independence Program participants or attest to a willingness to consider GAIN participants for future employment.

As required by your Board, language has been incorporated into the project specifications stating that the contractor shall notify its employees, and shall require each subcontractor to notify its employees, that they may be eligible for the Federal Earned Income Credit under the Federal income tax laws.

Bidders will also be required to show full compliance with Los Angeles County Code Chapter 2.200 (Child Support Compliance Program).

CONTRACTING PROCESS

Participation by Community Business Enterprises in the project is encouraged through Public Works' Capital Projects' CBE Outreach Program and by monitoring the good faith efforts of bidders to utilize CBEs.

As requested by your Board on February 3, 1998, this contract opportunity will be listed on the Office of Small Business website upon your Board's approval.

To ensure that the contract is awarded to a responsible contractor with a satisfactory history of performance, bidders are required to report violations of the False Claims Act, their civil litigation history, and information regarding prior criminal convictions. The information reported will be considered before awarding the contract.

Bids will be opened on October 31, 2000. It is anticipated that the site preparation work will begin in January 2001 and be completed in June 2002.

IMPACT ON CURRENT SERVICES

The existing hospital will remain open throughout the entire construction period. The project=s specifications include instructions to the contractor to comply with the requirements of the Environmental Impact Report/Environmental Assessment Mitigation Monitoring and Reporting Program that was certified by your Board on June 6, 2000. Construction activities will require patient access to the existing Outpatient Building to be relocated to the north side of the building from the south side. The contract requires that the new entrance on the north side of the Outpatient  Building be completed prior to closure of the existing south side entrance.

In order to offset the parking spaces which will be lost as a result of the demolition of Parking Lots 6 and 11 as part of the Site Preparation Work, work is currently underway to repair the earthquake-damaged Parking Structure 12. This work will be completed prior to the demolition of the other parking lots.

NEGATIVE DECLARATION/ENVIRONMENTAL IMPACT REPORT

On June 6, 2000, your Board considered and certified the Environmental Impact Report/Environmental Assessment and approved the Mitigation Monitoring and Reporting Program for the LAC+USC Medical Center Replacement Project. On June 7, 2000, the Federal Emergency Management Agency issued a Finding of No Significant Impact for the project and approved the Environmental Assessment Report.

Bids must conform to the drawings and project manual and all bidding requirements. This project requires the prime contractor to possess an "A" license classification at the time of award. The contractor should verify to his/her satisfaction that he/she holds the correct license for this type of project.

PRE-BID CONFERENCE

The Public Works' Project Management Team will hold a mandatory pre-bid conference at 9:00 a.m. on October 17, 2000, at the LAC+USC Medical Center Project Site, Project Management Team Trailers, located on the west side of State Street, just north of Marengo Street, Los Angeles, California 90033, to provide information on the project, bidding process, and answer any questions that the potential bidders may have.
