PURPOSE OF THE RECOMMENDED ACTIONS:

In approving the recommended actions, the Board is:

C delegating authority to the Director of Health Services, or his designee, to accept the forthcoming NCA from the CDC for the HIV/AIDS Rapid Testing Study in the amount of $533,779, for the period October 1, 2000 through September 30, 2001.

C authorizing the Director of Health Services, or his designee, to sign Amendment No. 3, to Agreement No. H-209571, substantially similar to Exhibit I, with the GLCSC for the continued provision of completing Phase III of the Rapid HIV Testing Study and to expand the service to include the testing of newly developed kits for the period October 1, 2000 through September 30, 2001, pending receipt of continued funding.

C authorizing the Director of Health Services, or his designee, to accept revisions to the NCA from the CDC for up to a maximum of 35%, for the period October 1, 2000 through September 30, 2001, subject to review and approval by County Counsel, and notification of the Board offices, in the event that the Department of Health Services (DHS) requires the redirection of salary savings to operating and equipment expenses during the term of the agreement.

JUSTIFICATION:

The CDC has provided funding to DHS for the provision of evaluating the accuracy and effectiveness of rapid HIV testing as a screening tool for HIV infection. Research studies have been conducted and Phase I and II have been completed. The additional CDC funds will provide continued support for the conclusion of Phase III of the study, and will include testing on the effectiveness of newly developed rapid HIV test kits, as a screening tool for HIV infection.

FISCAL IMPACT:

The total program cost is $533,779 for the period October 1, 2000 through September 30, 2001, of which $102,647 is being awarded to GLCSC, and will be 100% offset by CDC funding, upon receipt of continued funding. There are no net County costs.

FINANCING:

This project will be funded by a forthcoming NCA from the CDC for the HIV/AIDS Rapid Testing Study in the amount of $533,779, for the period October 1, 2000 through September 30, 2001.
Funding is included in the DHS Fiscal Year 2000-2001 Adopted County Budget and will be requested as continuing appropriation in subsequent fiscal years.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS:

Since February 1983, the County has accepted financial assistance from the CDC to support HIV/AIDS surveillance and seroprevalence activities. Since October 14, 1997, the County has accepted financial assistance from the CDC to support a comprehensive cohort study to determine the feasibility and acceptability of utilizing an alternative testing technique to test and deliver HIV test results.

On December 16, 1997, the Board accepted financial assistance from the CDC funding and authorized two sole source agreements with Charles R. Drew University of Medicine and Science and the GLCSC, for the period January 1, 1998 through December 31, 1998, with provisions for a 12-month automatic renewal through December 31, 1999. In that same action, the Board delegated authority to the Director of Health Services to accept subsequent amendments to the CDC HIV Prevention Counseling and HIV Partner Notification Project, Contract No. U62/CCU915096-01, for continued financial assistance for the periods 1997-1998, 1998-1999, and 1999-2000.

On December 7, 1999, the Board approved amendment to the agreements Charles R. Drew University of Medicine and Science and the GLCSC, for the period January 1, 2000 through September 30, 2000.

On April 27, 2000, the HHS Office for Human Research Protections (OHRP) suspended all research activities conducted at Charles R. Drew University of Medicine and Science. The agreement is scheduled to expire on September 30, 2000, and will not be renewed. Entering into a new agreement with a replacement agency would not be feasible because a new agency would be unable to reach the targeted number of participants required to complete the studies.

On August 14, 2000, the Department submitted a continuing application to the CDC for continued funding of the comprehensive cohort study to support the agreement with GLCSC for the period October 1, 2000 through September 30, 2001.

Attachments A and B provide additional information. Attachment B is the Grant Management Statement which the Board instructed all County departments to include in all Board letters for grant awards exceeding $100,000.

County Counsel has reviewed and approved the attached Amendment No. 3 with GLCSC as to form.

CONTRACTING PROCESS:

Because of the complexity of these studies and the expectation of the grantor that the cohort remain intact, a competitive solicitation process for the participation in these projects is not feasible.

It is not appropriate to advertise grant awards to the County on the Office of Small Business= Countywide Web Site.

IMPACT ON CURRENT SERVICES (OR PROJECTS):

The recommended Board actions will maintain the current level of program services throughout the County during the 12-month budget period, effective October 1, 2000 through September 30, 2001.

When approved, this Department requires three signed copies of the Board=s action.
