Attached is a copy of a resolution adopted by the Regional Planning Commission at its regular meeting on May 10, 2000, recommending that your Board conduct a public hearing to consider proposed Changes of Zone as set forth below.

IT IS RECOMMENDED THAT, AFTER THE CONCLUSION OF THE PUBLIC HEARING, YOUR BOARD:

1. Approve the recommendation of the Regional Planning Commission to establish the following changes of zone on the subject properties:

2. Find that the recommended zoning is consistent with the Los Angeles County General Plan.

3. Find the activity is not a project under the provisions of the California Environmental Quality Act.

4. Adopt the attached ordinance, previously approved as to form by the County Counsel, effecting the changes of zone and terminating urgency Ordinance No. 99-0096U as extended by urgency Ordinance No.99-0105U.

PURPOSE OF RECOMMENDED ACTION

The Board of Supervisors instructed the Department to initiate a zoning study of the undeveloped and underutilized properties along Stocker Street in the View Park and Baldwin Hills Zoned Districts and to recommend that the Regional Planning Commission consider changing the zoning of these parcels to an appropriate designation that would insure that any future development would be compatible with the surrounding neighborhood. On May 10, 2000, after closing the public hearing, the Regional Planning Commission approved a resolution recommending that the Board adopt the subject zone changes which will establish the appropriate zoning necessary to implement the Board=s instructions.

JUSTIFICATION

Past applications for permits on the subject properties required by the existing RPD-1-15U zoning along Stocker Street have shown that this zoning density is too intense for the sites and misleads developers as to the feasibility of development. The current C-3 zoning is too intense and inappropriate due to the lot configurations, traffic conditions, and access limitations.

Recognizing these facts, the Board of Supervisors adopted urgency Ordinance No. 99-0096U to temporarily restrict uses on the subject properties. Urgency Ordinance 99-0105U was subsequently adopted extended the interim provision until the subject zone change could be effectuated and the appropriate zoning on the properties could be established.

FISCAL IMPACT

Implementation of the proposed zone changes should not result in any new significant costs to the County or to the Department of Regional Planning.

FINANCING

It is not expected that the proposed zone changes will result in increased costs, and no request for financing is being made at this time.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

The proposed zone changes will establish designations that will allow for the coordinated development and enhancement of the Stocker Street corridor while eliminating the necessity to consider incompatible uses and the possibility of their establishment.

The Regional Planning Commission conducted a public hearing on January 26, 2000 regarding the ordinance, continued the hearing to April 12 to hear rebuttal testimony and recommended approval on May 10, 2000. A notice of public hearing was posted on-site, published and mailed pursuant to Sections 22.16.140, 22.60.174, and 22.60.175 of the County Code.

A public hearing before your Board is required pursuant to Section 22.16.200 of the County Code and Section 65856 of the Government Code. Required notice must be given pursuant to the procedures set forth in Sections 22.60.174 and 22.60.175 of the County Code. These procedures exceed the minimum standards of Sections 6061, 65090 and 65856 of the Government Code relating to notice of public hearing.

IMPACT ON CURRENT SERVICE (OR PROJECTS)

The proposed action will not impact the delivery of current services. It is expected that the proposed zone changes will prevent the various current and future service capacities along the Stocker Street corridor from being overwhelmed by development of the subject area.

ENVIRONMENTAL IMPACTS

The proposed zone changes constitute a regulatory action which is not a project under the provisions of the California Environmental Quality Act (Public Resources Code Section 21065) since the zone changes will not result in a direct or reasonably foreseeable indirect physical change in the environment.
