PURPOSE OF RECOMMENDED ACTION

These recommended actions are for your Board to annex the territories into County Lighting Maintenance District 1687 and County Lighting District LLA-1, Unincorporated Zone, and levy assessments for Fiscal Year 2001-2002 so that the necessary assessments can be applied to the benefitted properties for the installation, operation, and maintenance of these street lights.

JUSTIFICATION

Your Board approved Resolutions Initiating Proceedings and filed Petition 294-99 (Laxford Road) on January 4, 2000, and Petitions 310-99 (Laxford Road) and 323-109 (Markridge Road) on February 8, 2000. All of these Petitions are requests for the installation, operation, and maintenance of street lights, on new and existing wood poles with overhead wiring. The Petitions favoring the installation of these street lights were signed by property owners representing over 60 percent of the geographical area covered by each Petition. These locations are in the County of Los Angeles but are not within County Lighting Maintenance District 1687 or County Lighting District LLA-1, Unincorporated Zone.

FISCAL IMPACT

Sufficient funds are included in this Lighting District's budget to pay the annual cost of $2,200 for the installation, operation, and maintenance of these lights until assessments can be collected from the property owners within the territories to be annexed. The Southern California Edison Company will install the street lights without an installation charge.

FINANCING

The ad valorem property taxes and assessments collected from the benefitted properties within the territories to be annexed will fund the operation and maintenance of these street lights.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

These proceedings are governed by Chapter 26 of the Improvement Act of 1911 (Section 5820 et seq. of the Streets and Highways Code), the Landscaping and Lighting Act of 1972 (Section 22500 et seq. of the Streets and Highways Code), Article XIIID of the California Constitution (Proposition 218 approved by California voters in November 1996), and Sections 53753 and 54954.6 of the Government Code.

Public Works will conduct public meetings prior to your Board hearing, on Thursday, June 29, 2000 for Petitions 294-99 and 310-99 (Laxford Road) at 7:00 p.m. at the residence of Ms. Laura Navarro located at 17847 East Laxford Road, Azusa, California, and on Thursday, June 22, 2000, for Petition 323-109 (Markridge Road) at 7:00 p.m. at the residence of Mr. Derian Garnik located at 2845 Markridge Road, La Crescenta, California, at which time property owners may express their concerns or request additional information.

Public Works will post notices of the public hearing as provided by Section 5838 of the Streets and Highways Code.

The boundaries of the proposed annexation have been reviewed and approved by the County Assessor and Public Works in accordance with the requirements of Section 58850 et seq. of the Government Code. A copy of the diagram showing the boundaries of each proposed annexation territory is included with each respective Engineer=s Report. The specific detailed legal description for each territory is on file with Public Works.

With the passing of Proposition 218 (California Constitution, Articles XIIIC and XIIID) by the California voters in November 1996, any new assessment is now subject to property owner approval. As a result, an assessment ballot and public hearing notice will be mailed to all property owners within the proposed annexation boundaries no less than 45 days prior to the public hearing.

The Landscaping and Lighting Act also provides a procedure by which property owners within an area proposed to be annexed into a Lighting District may submit written protests against the proposed annexation. Therefore, if a majority protest exists under either the provisions of Proposition 218 or the Landscaping and Lighting Act, the proposed annexation shall be abandoned.

Upon your Board=s approval of the Resolution Ordering Annexation of Territory, Public Works will file a copy with the State Board of Equalization to allow them to make the filing required by Section 54900 et seq. of the Government Code.

The Resolutions of Intention to Annex Territory and the Resolution Ordering the Annexation of Territory to County Lighting Maintenance District 1687 and County Lighting District LLA-1, Unincorporated Zone, and to levy assessments and confirming the diagrams and assessment have been approved as to form by County Counsel.
