ACCEPTANCE OF A CONSTRUCTION CONTRACT
FOR KENNETH HAHN RECREATION AREA
LA CIENEGA GREEN BELT PROJECT
C.P. NO. 70805; SPEC. NO. 95-0110
(Second District- 3-Vote Matter)
IT IS RECOMMENDED THAT YOUR BOARD:
1. Accept the work of D&M Construction, Inc., which has completed the La Cienega Greenbelt Project in accordance with the plans and specifications, at a total construction cost of $125,038.97.
2. Instruct the Executive Officer-Clerk of the Board of Supervisors to notify D&M Construction, Inc., 24616 Stagg Street, West Hills, CA 91304, of the Board action taken.
3. Instruct the Department of Parks and Recreation to withhold all liens and 125% of outstanding stop notices from D&M Construction, Inc.'s retention and release any remaining balance to D&M Construction, Inc. upon resolution of stop notices.
The department is recommending that your Board accept the construction contract for completion of the landscaping and irrigation improvements at the Kenneth Hahn State Recreational Area park entry, as provided through the Safe Neighborhood ParksProposition of 1992 (the Proposition), under Section (8), Subsection (a), Paragraph (2), Subparagraph (S).
The project consisted of shrub plantings and irrigation installation on the median of La Cienega Boulevard's south bound off ramp to the park and the park's south bound on ramp to La Cienega Boulevard to enhance the appearance of the entrance to the park. The scope of work was reduced to exclude the planting of trees and shrubs along both sides of La Cienega Boulevard from the park entrance to Stocker Street (approximately 6,500 linear feet south of the park entrance) due to delays in obtaining the necessary property rights from the adjacent property owners.
The department was unsuccessful in obtaining the necessary project rights from the adjacent property owners to enter their property to plant trees and shrubs along both sides of La Cienega Boulevard from the park entrance to Stocker Street. Therefore, this portion of the project was omitted from the scope of work. The department will return to your Board upon obtaining these property rights and the identification of funding to complete the omitted work.
This project was the second phase of a greenbelt planting program around the periphery of Kenneth Hahn State Recreation Area to beautify the area for the benefit of the public. Phase I, which consisted of the installation of a greenbelt along La Brea Avenue, was accepted by your Board on July 15, 1997.
This second phase greenbelt project was substantially completed on June 4, 1998. Final acceptance can be recommended at this time as the contractor has submitted record drawings and the Certificate of Compliance (see Attachment B) in accordance with the contract requirements, as well as supplied other information requested by the Office of Affirmative Action.
There is no impact on the General Fund. The project was funded by the Regional Park and Open Space District under C.P. No. 70805.
The original contract was in the amount of $135,555 with $27,111 (20 percent) for change order and contingencies. The final construction cost of $125,038.97 includes change orders in the amount of $9,483.97, and a credit in the amount of $20,000 for the omitted scope of work. The total project cost, including plans and specifications, plan review, construction, consultant services, and County services, was $313,872.97. Therefore, the project was completed within the amount authorized by your Board (see Attachment A).
To date the department has paid D&M Construction, Inc. the amount of $113,397.35. The department has retained the balance of the construction costs (retention) in the amount of $11,641.62. Upon your Board's acceptance of the project as complete, the department would normally release the retention to D&M Construction, Inc. However, the retention is subject to withholds for liens and 125% of outstanding stop notices.
As of the filing date for this Board letter, the department has received two stop notices concerning this project in the amounts of $8,511.44 and $17,851.54. Because the amount to be withheld ($32,953.73) exceeds the retention of $11,641.62, no amount of the retention can be released to D&M Construction, Inc. until after the stop notices have been resolved.
This project is one of more than 200 capital improvement projects that the department is undertaking as a result of the voters' approval of the Safe Neighborhood Parks Propositions of 1992 and 1996.
On August 19, 1997, your Board adopted the plans and specifications for this project and authorized the Department to advertise for construction bids.
On October 7, 1997, your Board awarded a contract in the amount of $135,555 to D&M Construction, Inc., as the lowest responsible bidder, and authorized an additional $27,111 for change orders and contingencies.

On August 19, 1997, your Board found the project to be categorically exempt from the California Environmental Quality Act.
Please instruct the Executive Officer-Clerk of the Board to forward the original and four (4) copies of this letter and the executed agreement to the Department of Parks and Recreation for distribution.
