AGREEMENT TO PROVIDE DISASTER RECOVERY SERVICES

(ALL DISTRICTS - 3 VOTES)

IT IS RECOMMENDED THAT YOUR BOARD:

PURPOSE OF THE RECOMMENDED ACTION:

The purpose of this action is to provide ISD's Unisys Data Center with backup computing resources at SunGard's computer disaster recovery hotsite facility.

JUSTIFICATION:

The Agreement provides the County with an emergency backup facility for computer processing in case of a disaster. SunGard maintains the necessary hardware and software configuration in a ready state to conduct business within 24 hours of the County's declaration of a disaster.

The ISD Unisys Data Center, located in Downey, California, serves the critical needs of such customers as the DistrictAttorney, Department of Public Social Services, Children and Family Services, and other County departments. The County would suffer irreparable harm if the Unisys Data Center were rendered inoperable due to a disaster. Child Support Enforcement, General Relief (GR), Medi-Cal, Temporary Assistance for Needy Families (TANF), and Foster Care applications are all systems requiring disaster backup.

The proposed Agreement will allow ISD to meet its obligations for disaster recovery preparedness as specified by the State. Without the proposed Agreement, there would be no disaster recovery capability.

FISCAL IMPACT:

The Agreement has a three (3) year term with two one-year extensions as an option. The first-year cost is $432,000 for monthly subscription fees.

FINANCING:

The monthly subscription fee expense will be recovered through billings to County departments that use the Unisys Data Center. Adequate funding for the current fiscal year is provided in the County's adopted FY 1998-99 budget. Funding for the subsequent years will be requested in the budgets for FY 1999-00 and FY 2000-01.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS:

The Agreement is with SunGard Recovery Services, Inc. and is for a three (3) year term. ISD has determined that the services to be performed under this Agreement are of an extraordinary, professional and technical nature and are needed on a part-time or intermittent basis. The Agreement has been approved as to form by County Counsel.

The Agreement requires the contractor have a Year 2000 compliance program.

In addition, the contractor shall give first consideration for any employment openings to County employees targeted for layoff or qualified former County employees who are on a re-employment list during the life of the contract when filling future vacancies. The contract also requires that the contractor consider hiring participants in DPSS' GAIN program who meet the contractor's minimum qualifications for open positions. The County will refer GAIN participants by job category to the contractor.

The County Office of the District Attorney approved the Dependent Support Program provisions of this Agreement.

Community Business Enterprise (CBE) information is provided in Attachment 1. On final analysis and consideration of award, SunGard was selected without regard to gender, race, creed or color.

CONTRACTING PROCESS:

In September 1998, a Request For Proposals (RFP) was sent to thirty potential vendors to determine which firms were interested in providing service upon the expiration of the current Agreement. The RFP was also posted on the County Internet Web site. Only one vendor responded. The vendor, SunGard, submitted a comprehensive response.

IMPACT ON CURRENT SERVICES:

ISD's Unisys Data Center serves the critical needs of such customers as the Department of Public Social Services, Department of Children and Family Services, District Attorney, Auditor-Controller, Department of Health Services, and other Los Angeles County departments. The proposed Agreement will allow the County to provide a means of operating in the case of a disaster.

Services under the old Agreement will end on January 4, 1999.
