IT IS RECOMMENDED THAT YOUR BOARD:

PURPOSE OF RECOMMENDED ACTION:

California's welfare reform legislation (Assembly Bill 1542) adopted on August 11, 1998, directed county boards of supervisors and county superintendents of schools to appoint members to local child care planning committees. The legislation defines five (5) membership categories, each to account for 20 percent of the total. These categories are: consumers of child care and development services; child care service providers; community representatives; public agency representatives, and discretionary appointments. These categories are further defined in the legislation.

OnDecember 9, 1997, your Board adopted a membership slate to serve from December 1997 through August 1998. The attached slate updates the membership, includes an individual discretionary appointee from each Board office and sets out specific terms of office for each member. Prior to the identification of discretionary appointments by your Board, the proposed slate was endorsed by the Child Care Planning Committee (Committee), the Child Care Advisory Board and the Los Angeles County Superintendent of Schools. Given the size and diversity of our County, the Committee has also identified Organizational Liaisons to the Child Care Committee. The Organizational Liaisons are non-voting representatives to the Committee. Their

participation, combined with the voting members, ensures compliance with the legislativemandate and ongoing dialogues with the broadest possible spectrum of organizations working with children and families.

Local child care planning committees are required to submit copies of approved bylaws or operating procedures to the California Department of Education by December 15, 1998. The attached Policies and Procedures were adopted on the July 1, 1998 by the Committee and have been reviewed by County Counsel.

JUSTIFICATION:

The Child Care Planning Committee has been functioning since June 1991. At that time your Board authorized the Child Care Advisory Board to convene a planning body to identify local priorities for funding under the Federal Child Care and Development Block Grant. Subsequent legislation and funding requirements have modified the membership, structure and responsibilities of the Local Child Care Planning Committee.

The attached membership slate and Policies and Procedures comply with both the legislative mandates and the requirements of the California Department of Education.

FISCAL IMPACT:

There are no fiscal impacts associated with the adoption of the membership slate and Policies and Procedures for the Child Care Planning Committee.

FINANCING:

Financial support for local child care planning activities is provided under a contract with the California Department of Education/Child Development Division. The fiscal year 1998-99 funding level for Los Angeles County is currently set at $213,000 and is scheduled to increase to $256,000. This contract requires a $1 County match for every $3 provided by the State.

FACTS AND PROVISIONS:

Beginning in April 1998, the Membership Work Group of the Child Care Planning Committee reviewed the attendance of current members to identify those with three (3) or more unexcused absences. In addition, the Work Group reviewed the length of service of members, attempting to strike a balance between members who can provide a sense of continuity to the Committee and ensuring that the Committee membership is accessible to the full range of potential members. Membership Applications were distributed at various community meetings, press releases were sent to 30 newspapers within the County, and Superintendent Ingwerson notified
all school districts in the County of the recruitment effort. Over 70 applications were received
by the closing date of June 30, 1998. Some additional recruitment was conducted after that date

to arrive at an ethnically and geographically representative slate. The Child Care Planning Committee adopted the proposed slate (except the discretionary appointees by the individual Board offices) on August 5, 1998. Copies of the proposed slate were forwarded to the Board offices on August 13, 1998.

The proposed slate of members and Organizational Liaisons complies with the legislative mandates, includes representation from the County Departments of Children and Families and Public Social Services, and represents the ethnic, geographic and programmatic diversity of this County.

IMPACT ON CURRENT SERVICES (OR PROJECTS):

Assembly Bill 1542 defines a number of tasks for local child care planning committees. The following description highlights some of these tasks and local progress to date.

-- Elect a chair.

-- Conduct an assessment of child care needs in the county no less than once every five (5) years.

-- Prepare a comprehensive countywide child care plan designed to mobilize public and private resources to address identified needs.

-- Collaborate with subsidized and nonsubsidized child care and family service providers.

-- Encourage public input in the development of child care priorities.

-- Coordinate part-day programs, including state preschool and Head Start, with other child care to provide full-day services.

CONCLUSION:

The Committee is faced with a number of important and challenging tasks. We look forward to seating the new members and organizing our efforts to improve the availability, affordability, and quality of child development services for children and their families.

POLICIES AND PROCEDURES

Compliance with Brown Act: The Child Care Planning Committee will comply with the Brown Act.

Attendances and Participation: Although a quorum is constituted by fifty percent (50%) of the current membership, members are expected to attend all Child Care Planning Committee meetings, arrange for their alternate to attend, or to notify the staff to request an excused absence. No more than three (3) unexcused absences per year will be allowed. After the second such absence, the Membership Committee will contact the absent member. After a third unexcused absence, a letter will be sent from staff to the appointing body, notifying them of their appointee's failure to participate and requesting a replacement within a reasonable period.

- Each member is also expected to participate in at least one (1) work group.

- Each member will name an alternate to serve in his or her absence and will give Committee staff the alternate's name, address and phone. The member is responsible for maintaining communication with his or her alternate about the business of the Planning Committee and to make sure that his or her alternate is available to attend in his or her absence. Alternates are encouraged to attend and participate in discussions at all Planning Committee and work group meetings. In the absence of the member, the alternate will be entitled to vote.

Membership Recruitment: The Membership Committee will conduct recruitment in support of the recommending/appointing bodies and in compliance with the membership categories defined in AB 1542. To ensure optimal representation and access to this process, recruitment and outreach will be undertaken no less than three (3) months prior to the selection of members. Recruitment and selection will take into consideration geographic and ethnic representation, and will ensure that there will be at least one (1) member from each of the Service Planning Areas.

- Diversity within each category will be a primary consideration in the selection of members. For example, in the "Child Care Providers" category, every effort will be made to include representatives of programs provided under a variety of auspices (public, nonprofit, for-profit, church-related, cooperatives, family child care, resource and referral/alternative payment programs, etc.)

- Appropriate nominating groups will be designated for each of the membership slots. Each of the five Supervisors will name one member in the "Discretionary" category. The Superintendent of the County Office of Education will recruit members through local school district superintendents.

- Nominees will be presented for appointment before September of each year.

Terms of Office: Members will serve three (3) year terms, and may serve for up to two (2) consecutive three (3) year terms without a break. Former members will be eligible for re-nomination after a one (1) year hiatus. Members filling an unexpired term may be reappointed for a complete term without a waiting period. To establish some continuity for the Committee, at the time of implementation of new membership selection procedures, the Membership Committee will assign one-third of the members a one (1) year term, one-third a two (2) year term and one-third a three (3) year term. To the extent possible, assigned term length will be related to the length ofthe members past service and to participation.

Officers: The term of the Chair will be two (2) years. If the Chair's membership term expires during his or her term in office, the membership term will be extended through completion of the term of office.

In addition to recommending the membership roster, the Membership Committee will recommend the Chair-Elect. The Chair-Elect will begin his or her one (1) year term during the second year of the Chair's term. The Membership Committee will present their recommendation for Chair-Elect to the full Child Care Planning Committee when the membership slate is proposed.

In the event that the Chair or Chair-Elect cannot fulfill their terms, the Membership Committee will convene and prepare recommendations for consideration by the full Committee. Every effort will be made to act in a timely manner.

Stipends: The Child Care Planning Committee will cover the cost of child care and transportation for parent representatives (not to exceed $25 per meeting) and for substitutes for licensed family child care providers (not to exceed $40) for regular meetings and for work group attendance for Committee Members or Alternates. In no instance will members be compensated for their time. Requests for all stipends must be submitted on a form supplied by staff.

Organizational Liaisons: Following the appointment of Child Care Planning Committee members, the Membership Committee will present a slate of organizations with whom the Child Care Planning Committee will seek Liaisons. The intent is to ensure that the combination of Committee membership and Organizational Liaisons provide the Child Care Planning Committee with effective communication links across a broad spectrum of organizations from throughout the County.

Organization Liaisons will be sought from a limited number of groups that are: dedicated to goals that are compatible with the Child Care Planning Committee; have documented constituencies that are countywide; and have an interest and commitment to participate in Child Care Planning activities on a regular basis. The list of organizational liaisons will be reviewed annually by the Child Care Planning Committee.

Organizational Liaisons will be encouraged to participate fully in Committee discussions and activities and to regularly report on the work of their organization. Organizational Liaisons will not have voting rights.

Conflict of Interest: No member of the Planning Committee will participate in a vote if he or she has a proprietary interest in the outcome. For the purpose of this provision, a person with a proprietary interest is defined as one who is employed by, acts as a paid consultant to or functions in a decision making capacity with any agency which stands to gain from an action of the Committee. Interested persons will be welcome and encouraged to participate in the discussion of issues after they publicly identify their interest, but must recuse themselves from any vote.

Before voting, members will be reminded of their responsibility to assess the potential for conflict of interest. Members are required to declare their affiliations on the membership application. Incase of challenge, the membership applications will be reviewed.

Complaint Procedure: Any complaint by a member of the Planning Committee or any other person regarding any action, policy or procedure of the Planning Committee, may be addressed through
the following steps:

1) The complaint/concern should be brought to the attention of the Planning Committee staff in writing. The staff will attempt to resolve the complaint and/or to provide a response to the complaining party within fourteen (14) calendar days.

2) If the staff is unable to resolve the complaint, the complaining party may submit the complaint in writing on a Complaint Form (available from staff) to the Grievance Committee. This Committee will be composed of members of the Planning Committee including one person from each of the five (5) membership categories, and at least one (1) member of the Child Care Advisory Board. The Grievance Committee will review the complaint and may or may not, at the Committee's discretion, meet with the complaining party. The Grievance Committee will respond to the complaint within thirty (30) calendar days of receipt of the written grievance.

3) If the Grievance Committee's response is not satisfactory to the complaining party, she or he may submit the complaint to the Board of Supervisors for response.

Amendments to the Policies and Procedures: Amendments to this document can be entertained at anytime and will be initiated by the adoption of a motion by the Child Care Planning Committee. The Policies and Procedures Work Group will respond to the motion and will bring a recommendation back to the Committee for review and adoption in a timely manner.
