PURPOSE OF RECOMMENDED ACTION

This action enables the County to sell a surplus Road property, Road Yard 445, at auction to the highest bidder. The property is located south of Imperial Highway at 12641 South Paramount Boulevard in the City of Downey.

JUSTIFICATION

The County acquired the fee title to Road Yard No. 445 for road maintenance of the immediate area. Maintenance for this area is now being handled by the Hollydale Yard and Road Yard No. 445 is no longer needed.

FISCAL IMPACT

The proposed minimum bid of $300,000 is within the range of fair market value. The proceeds of the sale will be deposited in the County Road Fund.

FINANCING

The property is being offered for all cash. The successful bidder must deposit $20,000 at the time of the auction and execute a Purchase Agreement. The deposit is nonrefundable and must be a cashier's check or bank money order. The successful bidder will have 90 days from the date of the auction to pay the balance of the successful bid amount.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

As required by Government Code Section 65402, the Planning Commission of the City of Downey, by letter dated May 29, 1998, has indicated the proposed sale conforms with its adopted General Plan.

As required by Government Code Section 54222, the proposed sale was submitted to all pertinent agencies notifying them of the proposed sale. By letters dated May 29, 1998, April 14, 1998, and April 3, 1998, the City of Downey Housing Division, Downey School District, and State Resources Agency, respectively, informed us that they had no interest in purchasing this property. Since no answer was received from any other agency within the 60-day period stipulated in this Section, it is conclusively deemed that no other agency intends to purchase the property.

The Resolution and Notice of Intention to Sell has been approved by County Counsel. Prior to submission of the Quitclaim Deed to the Chairman for execution, the Quitclaim Deed will be approved by County Counsel. The Quitclaim Deed will be recorded.

The Quitclaim Deed will not transfer rights to any oil, gas, petroleum, or other hydrocarbons and minerals.

The sale as recommended is in compliance with Sections 25520 to 25538, inclusive, of the California Government Code.

IMPACT ON CURRENT SERVICES OR PROJECTS

The revenues from this sale will be used for road purposes. Furthermore, the sale eliminates the need to maintain the property, reduces expenses and liability, and will provide future revenues through assessment and taxation.

NEGATIVE DECLARATION/ENVIRONMENTAL IMPACT REPORTS

With respect to requirements of the California Environmental Quality Act (CEQA), this sale of property transaction is categorically exempt, as specified in Class 12 of the Environmental Document Reporting Procedures and Guidelines adopted by your Board
on November 17, 1987, Synopsis 57, and Section 15312 of State CEQA Guidelines.

CONCLUSION

This action is in the County's interest. Enclosed are an original and duplicate Resolution and Notice of Intention to Sell. Please have the Executive Officer execute both the original and duplicate, returning the duplicate to this office.

An original and two duplicate Quitclaim Deeds will be prepared in favor of the successful bidder. Upon presentation by the Department, please have the Chairman sign the original and one duplicate and have them acknowledged by the Executive Officer of the Board of Supervisors. Return the executed original and one duplicate to this office, retaining one duplicate for your files.

One approved copy of this letter is requested.
